Status Restore

For certain people who cease to have legal status in Canada, it is possible to request status restoration within 90 days after the visa expires or after the visa application has been refused.

When a temporary resident, visitor, worker, or student status restoration application is received at the Case Processing Center, an immigration officer checks the merits of the application to determine if the applicant with no status is a possible candidate for restoration .

Regardless of the decision of the immigration officer, any fee paid for processing will not be returned to the applicant.

The applicant, after having his visa application denied, will be informed by letter that his status has expired. However, immigration will be willing to consider a status restoration request. Although the applicant has 90 days to request restoration, it is advisable to do so immediately.

An invitation to apply for status restoration does not mean that it will be approved. Immigration will keep basic information about the denied application, facilitating the process when the status restoration request is received.

For student and temporary workers, in addition to the status restoration fee it is necessary to pay the value of the student’s visa or work.
